SALE GENERAL CONDITIONS
These are the General Terms and Conditions of Sale of the company AZUKOMESI, S.L. (hereinafter, AZUKOMESI), which will market the products through the website: https://egurenugarte.com/, owned by EGUREN UGARTE, S.A.
1. Purpose, Company Identity, and Contact Information.
1.1 These terms aim to regulate the relationship between AZUKOMESI and the Client regarding all transactions carried out through the website https://egurenugarte.com/.
1.2 It is hereby stated that these terms and conditions apply exclusively to online sales of products presented on the website: https://egurenugarte.com/ by AZUKOMESI, S.L. 2. Applicability of the General Terms and Conditions of Sale
2.1 Each order placed with AZUKOMESI through the Internet will be governed by these General Terms and Conditions of Sale. The confirmation of an order for a product offered on the website https://egurenugarte.com/ constitutes the customer’s explicit acceptance of these general terms and conditions of sale, thereby formalizing the agreement.
The Customer acknowledges that they have read, understood, and unreservedly accepted these General Terms and Conditions of Sale. We therefore remind them of the importance of reading them carefully.
2.2 AZUKOMESI reserves the right to modify these General Terms and Conditions of Sale by publishing an updated version on this same page. The updated version will apply to all orders placed after AZUKOMESI has published the new version of its General Terms and Conditions of Sale on the website.
3. Orders
3.1 By placing an order through this website, the Customer makes a purchase request for the products they have selected under these General Terms and Conditions of Sale.
3.2 The products are offered on this website within the limits of the available quantities. If your order exceeds the stock, you will be informed immediately.
4. Order Confirmations
4.1 By accepting these General Terms and Conditions of Sale, orders placed via the Internet and confirmed by AZUKOMESI will constitute a binding and fully effective contract between the parties.
4.2 AZUKOMESI reserves the right to reject orders due to force majeure or in cases of non-payment.
4.3 The information recorded by AZUKOMESI serves as definitive proof of the order and the entire transaction. The information recorded by the payment system constitutes definitive proof of the financial transactions.
4.4 If the contracted product is unavailable, the Customer will be informed immediately. AZUKOMESI may offer a product with similar characteristics and equal or superior quality at no additional cost.
5. Prices
5.1 The prices to be paid for the items requested by the Customer are those displayed on this website at the time the Customer places their order and detailed in the order confirmation, including VAT, except for orders destined for Mallorca, Canary Islands, Ceuta, and Melilla. Shipping costs will be detailed at the end of the purchase process, once the delivery address has been entered. These shipping costs will depend on the delivery location and will be entirely borne by the customer. The total shipping costs will be determined during the payment stage of the Purchase Process. For orders destined for Mallorca, Canary Islands, Ceuta, and Melilla, the total shipping costs referred to in the previous paragraph do not include customs clearance fees or taxes that may apply to the importation of products into these territories, which must be paid by the customer. International orders may be subject to customs clearance charges, which will always be borne by the customer. 5.2 The shipping costs will be invoiced based on the rates indicated at the time the Customer places their order, calculated specifically according to the size of the order. The Customer will be duly informed of these amounts before placing their order.
6. Delivery
6.1 All orders confirmed by AZUKOMESI will be delivered to the delivery address specified by the Customer when placing their order, within a period of 2 to 5 business days. We do not accept any responsibility for receipt by another person on their behalf without proper authorization when such receipt is correctly carried out at the specified delivery location.
6.2 Deliveries can only be made within the Peninsula.
6.3 If the order cannot be delivered for reasons beyond AZUKOMESI’s control, an attempt will be made to contact the Customer again to agree on a new delivery location and date.
If the delivery still cannot be made, the order will be returned to AZUKOMESI’s warehouses, and from that moment, a full refund of the amounts paid by the Customer will be processed within fourteen (14) calendar days.
6.4 In case the product is delayed or does not arrive at its destination, the Customer may contact AZUKOMESI’s Customer Service: (+34) 945 600 766.
7. Verification of the goods
7.1 We remind the Customer that they are responsible for verifying the quantity, condition, and state of the goods at the time of delivery. Upon receiving the package, the Customer should:
- Check the conformity of the goods received at the time of delivery.
- Report any anomalies by noting their reservations.
Transportation providers do not allow the return of goods if the Customer opens the package in their presence. However, the exterior of the box can be inspected, and if it is found to be damaged, damp, or wet, the Customer should not accept the order. The transport agency will notify us of the incident, and we will automatically send a replacement at no additional cost. If the bottles received do not match the order or the product is defective, simply send an email to tienda@egurenugarte.com or contact us at (+34) 945 600 766, providing your details and order information. We will replace the order at no cost to you.
7.2 Without prejudice to your contractual and legal rights, we kindly ask that, in order to process any incident related to the shipment of the goods, you notify us within a maximum period of 24 hours of any issues, such as missing or lost products, damaged goods, opened merchandise, etc. Once AZUKOMESI certifies that the defect is attributable to them, the company will replace the goods at no additional cost. Delivery, whether to your home or store, entails the transfer of risk, meaning that from that point onward, any deterioration of the products, loss, or theft becomes the responsibility of the carrier, which could delay the replacement of damaged goods. In the event of an error, breakage during shipment, or a defect in the product, AZUKOMESI commits to replacing the defective product with an identical one, provided availability. If the replacement is not possible, the cost of the product will be reimbursed within a period of 14 calendar days.
8. Refunds
8.1 In accordance with the provisions of Royal Legislative Decree 1/2007 of November 16, approving the revised text of the General Law for the Protection of Consumers and Users, the customer may exercise their right of withdrawal without providing reasons and return any non-food product that they do not find satisfactory within a maximum period of fourteen (14) calendar days following the date of receipt of the product. The date on the receipt of delivery will serve to initiate the aforementioned fourteen (14)-day period.
8.2 For the purposes mentioned above, we remind you that AZUKOMESI will only accept returns of non-food products if they have not been unsealed from their original packaging for reasons of food safety and are accompanied by the corresponding proof of purchase. No package lacking the sender’s identifying elements (name, surname, address, order number) will be accepted.
8.3 AZUKOMESI will arrange the collection of the items subject to withdrawal. The Customer must pack the items securely and make them available to AZUKOMESI within a maximum period of five (5) calendar days from the notification of withdrawal. Once the return has been properly communicated by the Customer, AZUKOMESI will refund the price of the returned merchandise within a maximum period of fourteen (14) calendar days from the Customer’s communication of withdrawal.
8.4 Wine tourism vouchers are valid for one year and are non-refundable.
8.5 The Customer may exercise their right of withdrawal by requesting it via phone (+34) 945 600 766 or through email at tienda@egurenugarte.com, providing their contact email address and order number. AZUKOMESI will respond to the user, specifying precise instructions for exercising the right of withdrawal.
8.6 Under no circumstances will the right of withdrawal be accepted for food products. Withdrawal is not applicable in the cases contemplated under Article 103 of Royal Legislative Decree 1/2007 of November 16, which approves the revised text of the General Law for the Protection of Consumers and Users. By way of example but not limited to, returns will not be accepted in cases of personalized or perishable products, without prejudice to the foregoing.
9. Payments
9.1 Payments made by credit card will be charged once the Customer receives the confirmation email for their order. Credit card details will be encrypted for security reasons.
10. After-Sales Service and Handling of Complaints and Claims
10.1 There is a Customer Service and Incident Management Department where you can submit your requests, complaints, and claims through various means. AZUKOMESI provides access to the Eguren Ugarte Customer Service phone line at (+34) 945 600 766, where you will be directed to the corresponding department, as well as through the website https://egurenugarte.com/. AZUKOMESI is committed to responding to such requests, complaints, and claims within a maximum period of one month. Similarly, in accordance with Regulation (EU) 524/2013, which applies throughout the European Union, Eguren Ugarte provides users of the website with the following link: http://ec.europa.eu/consumers/odr/.
11. Language
The language in which the contract between AZUKOMESI and the Customer will be finalized is Spanish.
12. Force Majeure
12.1 AZUKOMESI guarantees the quality of the products contracted through its website. All rights granted to consumers and users under the applicable laws are guaranteed. AZUKOMESI will make every reasonable effort to fulfill its obligations.
12.2 However, AZUKOMESI cannot be held responsible for delays or failures in delivery caused by circumstances beyond its reasonable control. Such circumstances include strikes, wars, natural disasters, or any other situation that may prevent the production, transportation or delivery of the products.
12.3 In case of delays, AZUKOMESI will fulfill its obligations as soon as reasonably possible and reserves the right to fairly and reasonably distribute any remaining stock among its Customers.
13. Code of Conduct
13.1 AZUKOMESI believes that its business activities and the achievement of its objectives must be carried out while respecting its corporate citizenship commitment. Therefore, it has a Code of Conduct aimed at ensuring the values that guide all its business operations and its commitment to the law. 14. Customer Responsibilities
14.1 The Customer is obligated to make lawful use of the services and products offered by AZUKOMESI, without violating current legislation or infringing on the rights and interests of third parties.
14.2 The Customer guarantees the truthfulness and accuracy of the information provided during the purchase process, avoiding causing harm to AZUKOMESI due to incorrect information.
14.3 The Customer commits to paying the price of the contracted products.
14.4 Non-compliance with any of these General Terms and Conditions of Sale may result in the rejection of the order by AZUKOMESI without prior notice to the Customer and without entitling the Customer to any compensation.
15. Applicable Law and Jurisdiction
15.1 These General Terms and Conditions of Sale are governed by Spanish law and Any conflict or discrepancy in the interpretation or application of the same shall be submitted to the Courts and Tribunals that, where appropriate, are provided for by the applicable legal regulations on the matter of competent jurisdiction, in which, in the case of final consumers, the place of compliance with the obligation or to the consumer’s domicile.
15.2 If the Customer is a company, both parties expressly waive any other jurisdiction and submit to the Courts and Tribunals of Vitoria-Gasteiz.
16. Delivery Conditions
Anywhere within Spanish territory, Eguren Ugarte strives to deliver your orders within five business days following the receipt of the order, provided the order is placed Monday through Friday before 7:00 PM. Any indicated time frame counts business days exclusively. Deliveries are not made on Saturdays, Sundays, or public holidays.
